The study of corporate social responsibility has been the object of much research in recent decades, although there is a need to continue investigating its benefits as a marketing tool. In the current work we adopt a multi-dimensional perspective of social responsibility, and we carry out market research to determine the perceptions of users of mobile telephone services about economic, legal, ethical and social aspects of their operating companies. With these data we determine the structure and components of the concept (...) of social responsibility. Subsequently, this is related with the overall evaluation of the service and loyalty by means of a model of structural equations, in order to determine the influence of corporate social responsibility on these concepts, and hence its benefits as a commercial tool. This paper offers a brief reply to William Morgan’s critique of my review of Andrei Marmor’s Social Conventions . Morgan’s principal critique is that I am wrong to think that the constitutive rules of games do not determine their aims and values. In particular, with regards to chess, Morgan argues that the rules of chess determine that the aim of playing chess is to win the game. I defend my position that one can play the game of chess without the (...) aim of winning - e.g. one can aim to play beautifully, and not, as Morgan suggests, only to win beautifully. More broadly, I argue for an account of games that is sensitive to the gap between playing and the game’s constitutive rules. Ultimately, the argument points to the descriptive priority for the social sciences of the concept of ‘play’ over the concept of games understood as ‘rule-governed domains’. (shrink)

O presente texto é uma exposição do Direito Abstrato da Filosofia do Direito de Hegel. O seu objetivo é ressaltar o sentido do ter, conteúdo do Direito Abstrato, como pressuposto para a moralidade, isto é, para o ser livre. A argumentação consiste em lembrar que a liberdade não se restringe a discursos e interesses individuais, mas em criar as condições necessárias para que uma vida seja livre. Assim, o processo dialético dos momentos da concretização da liberdade será de fato um (...) modo de relação social onde o fundamento do direito será a personalidade em geral, na sua relação com as coisas, esfera da legalidade. Tal esfera será também, na sua concretude, um pressuposto para a moralidade. Um miserável não pode ser livre, pois, segundo Hegel, o direito de ter é um direito universal e não somente de alguns particulares. Desse modo, o Direito para Hegel é a ideia da efetivação da liberdade que compreende o direito de ter, o direito de ser livre e o direito de ter e ser livre, que constitui o direito de cidadania. Entretanto, o que justifica esta análise na atualidade é exatamente o não cumprimento deste direito de ter, numa sociedade moralmente antagônica, cujo tecido continua criando a riqueza e a miséria. Neste artigo comentamos somente o direito de ter nas suas explicitações: a personalidade, a possessão, a propriedade, o contrato, a injustiça e a violência. (shrink)

With the emergence of numerous link prediction methods, how to accurately evaluate them and select the appropriate one has become a key problem that cannot be ignored. Since AUC was first used for link prediction evaluation in 2008, it is arguably the most preferred metric because it well balances the role of wins and the role of draws. However, in many cases, AUC does not show enough discrimination when evaluating link prediction methods, especially those based on local similarity. Hence, we (...) propose a new metric, called W-index, which considers only the effect of wins rather than draws. Our extensive experiments on various networks show that the W-index makes the accuracy scores of link prediction methods more distinguishable, and it can not only widen the local gap of these methods but also enlarge their global distance. We further show the reliability of the W-index by ranking change analysis and correlation analysis. In particular, some community-based approaches, which have been deemed effective, do not show any advantages after our reevaluation. Our results suggest that the W-index is a promising metric for link prediction evaluation, capable of offering convincing discrimination. (shrink)

With this study, we aim to test the predictive relationships between determinants of major choice and academic expectations and to analyze gender differences, using six items of the Determinants of Major Choice Scale and the Academic Perceptions Questionnaire to assess AEs. A convenience sample of Portuguese and Spanish first-year students, mostly composed of women, was selected from two public universities. The invariance of the multivariate regression model with latent variables of the effect of DMC on AEs, with determinants linked to (...) Personal Characteristics and Mediating Agents as AE predictors, was tested across gender with LISREL. The invariance test of the multivariate regression model across gender fit the data well and revealed an equivalence of slopes between women and men, which allows a unique interpretation of the model’s predictive relationships for both genders. We also found statistically significant predictive relationships of PCs for six AE factors and MAs for five AE factors. The results showed theoretical relationships with the self-determination theory. At a practical level, they indicated the importance of PCs and MAs to design AE intervention programs in Higher Education institutions. (shrink)

Experiments involving these toys were implemented with 15 families with preschool-aged high-functioning autistic children. The results showed that loose sequin , which possessed equal tactile and visual intensities, was strongly correlated with frequent smiling/laughing and high enjoyment levels. The fabric provided a loose tactile sensation regarding surface interweave uniformity and a bright visual sensation regarding visually (...) perceived luster; suede exhibited a greater tactile intensity than visual intensity and was correlated with eye contact and activity response. This fabric possessed a smooth visual sensation regarding visually perceived smoothness; and loose sequin , which possessed equal tactile and visual intensities, was highly correlated with finger pointing and initiation. This fabric offered a thin tactile sensation regarding surface interweave thickness and a bright visual sensation regarding visually perceived luster. We suggest applying fabrics to composite toys. Specifically, loose sequin can be used initially to encourage autistic children to interact; subsequently, suede can enable sustained parent-child interaction. Két, közelmúltban megrendezett filozófiai konferencia előadásaiból válogat a tanulmánykötet. A 2015-ben a kaposvári egyetemen és 2016-ban a Filozófiai Intézetben megtartott tanácskozások témája az érzelmek és a jelentés volt. Az érzelmek mibenléte, az ésszel és értelemmel való kapcsolata már a kezdetek óta foglalkoztatta a filozófusokat, érthető hát, hogy a kötet élén két filozófiatörténeti esettanulmány áll, az első az ókori sztoikusoknál vizsgálja az érzelmek és a cselekvés viszonyát, a másik a bűnös érzelmek problémáját mutatja be a skolasztika korában. A folytatásban már a (...) kortárs filozófiai viták egy-egy témája kerül elő: az éntapasztalat fenomenológiai leírása és az érzelmek lehetséges szerepe a racionális vitákban. Az érzelmekről szóló blokkot záró két kognitív pszichológiai tanulmány az empirikus tudományok felől közelíti meg a problémakört. Integrating stakeholder agency theory with the instrumental corporate social responsibility (CSR) literature, this study explores how award-winning CEOs consider personal interests and balance competing stakeholder demands when they decide between external and internal CSR, or CSR focus. Using a difference-in-differences research design, we find that after winning a prestigious media award, CEOs engage in more external CSR, which is more visible to the public, and less internal CSR, which is less likely to attract public attention. We find that such an (...) influence on CSR focus is more salient for award-winning CEOs with lower stock ownership (i.e. a stronger self-serving motivation) than for CEOs with higher stock ownership. Furthermore, we explore the role of stakeholder salience in modifying award-winning CEOs’ decisions about CSR focus. When external stakeholder salience is higher (e.g. higher media coverage), award-winning CEOs' manipulation of CSR focus by increasing external CSR and decreasing internal CSR is more salient. However, such effects can be dampened when internal stakeholder salience is higher (e.g. higher human capital intensity). Our study contributes to the instrumental CSR literature by demonstrating the underlying processes and boundary conditions of how awards affect CEOs' balance of stakeholder salience. (shrink)

The Kiki-Bouba effect comprises a relation between two abstract figures and two non-words: the star-shaped figure is called 'Kiki' and the rounded figure 'Bouba'. The effect is explained by a sound-vision synaesthesia: certain sounds are associated with certain shapes in a non-arbitrary manner.When we asked the participants to decide which of the two figures, the star-shaped or the rounded one, to call yin and which yang, some 85% choose the star-shaped figure as yin. There are previous cases of synaesthesia where (...) personality is attributed to numbers or letters. In our results, the word Kiki is overall happy, clever, small, thin, young, unpleasant, and nervous. The starshaped figure is overall clever, tall, small, slim, nervous, unpleasant, and upper-class. That is, the correspondence above all concerns the qualifying adjectives clever, unpleasant, and nervous, as well as the physical appearance small and thin. This brings us to the fat-thin effect. Cinema, literature, comics, and children's programmes are full of contrasting figures: Don Quixote and Sancho Panza, Laurel and Hardy , Asterix and Obelix, Tintin and Captain Haddock, Bert and Ernie , or the Spanish comic about very naughty twin boys called Zipi and Zape . Our main conclusion is that first names and last names are not entirely arbitrary. There is a correspondence between names and physical characteristics and concepts . The Kiki-Bouba effect is a semantic one. (shrink)

El presente artículo elucida la figura y el lugar del mar en parte de la obra literaria de Camus, en particular, La peste, El estado de sitio y El primer hombre. Para ello se toman como punto de partida dos posibles interpretaciones. En primer lugar, se aborda al mar como reflejo del estado vital de la existencia humana y, más precisamente, de los ciudadanos de Orán y de Cádiz, y de los niños de Argel. En segundo lugar, se intenta entender (...) a la existencia humana como reflejo de la libertad y la vitalidad del mar, deidad indiferente que acompaña y protege al hombre. A partir del análisis de dichas interpretaciones, se intenta demostrar como el mar es, para Camus, un medio para simbolizar y encontrar el valor de la vida. (shrink)

RESUMEN Cuando se mira la masacre de El Salado, es difícil no preguntarse por los factores que llevaron a esta comunidad de los Montes de María, en el contexto de la guerra rural que vivía Colombia a finales del siglo XX, a volverse un objetivo militar por parte de las A.U.C. (Autodefensas Unidas de Colombia), es decir, a recibir la marca o estigma de 'pueblo guerrillero'; en otras palabras, a convertirse en un pueblo masacrable. El presente artículo intenta abordar esta (...) cuestión y para ello analiza las consecuencias de la ocupación de las FARC desde su ingreso a la región en los noventa. Los modos como este poder fareano dispuso de lógicas guerreristas y dejó poco margen de maniobra y libertad para los pobladores de El Salado; los saladeros no tuvieron opción ni libertad, y la cohabitación se confundió con la colaboración, la pasividad con la pertenencia. En una segunda parte, revisa los efectos de la arremetida brutal de las FARC contra cierto grupo de pobladores (en especial, ganaderos y fuerza pública); de algún modo, la masacre del 2000, ejecutada por las AUC, fue una respuesta impulsada por un odio desmedido frente a una violencia también excesiva por parte de las FARC en los años anteriores a la masacre. En este apartado, se habla acerca del odio y la venganza que se constituyen en afectos que contribuyeron decisivamente -entre otros más- a la masacre del año 2000. Las elaboraciones sobre la economía del odio de Sara Ahmed (2015) y las de Laura Quintana sobre los afectos (2020 y 2021) serán fundamentales. ABSTRACT When looking at the El Salado massacre, we wonder about the factors that led this town of los Montes de María, in the context of the rural war in Colombia at the end of the 20th century, to become a military objective by the A.U.C (Autodefensas Unidas de Colombia), that is, to receive the brand or stigma of 'guerrilla people'; that is, to become a massacrable town. This article tries to address this issue, thus analyzing the consequences of the FARC occupation since its entry into the region in the nineties. Ways like this Farean power had warmer logic and left little room for maneuver and freedom for the residents of El Salado; The saladeros had no choice or freedom, and cohabitation was confused with collaboration, passivity with belonging. in a second part, it reviews the effects of the brutal attack by the FARC against a certain group of residents (especially, ranchers and the military); in a way, the 2000 massacre, carried out by the AUC, was an inordinately hateful response to excessive violence by the FARC in the years before the massacre. In this section, we talk about the hatred and revenge that constitute elements that contributed decisively -among others- to the 2000 massacre. The elaborations on the economy of hate by Sara Ahmed (2015) and the elaborations of Laura Quintana on affects (2020 and 2021) will be fundamental. (shrink)

INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. In fact, there is no direct mention of “deus” in Rosa’s text: Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Both are fascinating. In Rosa’s excerpt, the rhythm is unmistakable and precise, despite, of course, the indices of hesitation: the commas, the Eh, the uncomfortable way of searching through prolongation and wait. This is the sort of paradox Rosa can engage within a sentence. W.Martinez’s does this as well, at a scale that reverberates beyond the sentence, and with one noticeable addition: deus. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. This isn’t so different from what Rosa says himself: The Sir look…see: the most important and beautiful, of the world, is this: that the people are not always same, still were not completed — but that they go always shifting. They tune or detune. We find this so readily in W.Martinez’s translation, this tuning and detuning. Um dia, só por graça rústica, ele matou um velhinho que por lá passou, desvalido rogando esmola. O senhor não duvide – tem gente, neste aborrecido mundo, que matam só para ver alguém fazer careta... Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Esse Aleixo era homem afamilhado, tinha filhos pequenos; aqueles eram o amor dele, todo, despropósito. Dê bem, que não nem um ano estava passado, de se matar o velhinho pobre, e os meninos do Aleixo aí adoeceram. Andaço de sarampão, se disse, mas complicado; eles nunca saravam. Quando, então, sararam. Eles têm um filho duns dez anos, chamado Valtei – nome moderno, é o que o povo daqui agora apreceia, o senhor sabe. Pois essezinho, essezim, desde que algum entendimento alumiou nele, feito mostrou o que é: pedido madrasto, azedo queimador, gostoso de ruim de dentro do fundo das espécies de sua natureza. Em qual que judia, ao devagar, de todo bicho ou criaçãozinha pequena que pega; uma vez, encontrou uma crioula bentabêbada dormindo, arranjou um caco de garrafa, lanhou em três pontos a popa da perna dela. O que esse menino babeja vendo, é sangrarem galinha ou esfaquear porco. – “Eu gosto de matar...” – uma ocasião ele pequenino me disse. Em tanto, ponho primazia é na leitura proveitosa, vida de santo, virtudes e exemplos – missionário esperto engambelando os índios, ou São Francisco de Assis, Santo Antônio, São Geraldo... Eu gosto muito de moral. Raciocinar, exortar os outros para o bom caminho, aconselhar a justo. Minha mulher, que o senhor sabe, zela por mim: muito reza. Ela é uma abençoável. Compadre meu Quelemém sempre diz que eu posso aquietar meu temer de consciência, que sendo bem-assistido, terríveis bons-espíritos me protegem. Ipe! Com gosto... Este artículo tiene por objetivo establecer una relación entre la fenomenología merleau-pontiana y la expresión literaria. Dicha relación se fundamenta en la importancia que Maurice Merleau-Ponty otorga a la capacidad expresiva de la literatura. Para alcanzar este objetivo, se elucidará, en primer lugar, la expresión literaria a partir de las herramientas de la fenomenología merleau-pontiana y se buscará sostener la necesidad de utilizar expresiones propias de la literatura para lograr una descripción verdadera del fenómeno. En ese primer apartado, se explicitará (...) la importancia que tiene la literatura y su modo particular de expresión del mundo vivido para llevar a palabra al mundo mudo de la percepción mediante el análisis de algunos pasajes de la obra merleau-pontiana en que se elucida el modo de presentar de la novela de Marcel Proust. La segunda parte tendrá por objeto realizar un breve análisis de _Océano mar_, de Alessandro Baricco, con el propósito de ilustrar la primera parte. En esta, se explicitará la capacidad del lenguaje literario para expresar el mundo buscando mostrar cómo una obra literaria posibilita la expresión de las esencias, en este caso, la del mar. En nuestra conclusión, sostendremos que Merleau-Ponty considera la tarea del escritor y la del filósofo casi de modo análogo en tanto ambos están llamados a _decir_ el mundo mediante un lenguaje que nos permite un acercamiento más originario al ser salvaje, aquel propio de la literatura que surge en lo sensible y entraña las relaciones que lo han visto nacer. Nurses are responsible for the well-being and quality of life of many people, and therefore must meet high standards of technical and ethical competence. The most common form of ethical guidance is a code of ethics/professional practice; however, little research on how codes are viewed or used in practice has been undertaken. This study, carried out in six European countries, explored nurses’ opinions of the content and function of codes and their use in nursing practice. A total of 49 focus (...) groups involving 311 nurses were held. Purposive sampling ensured a mix of participants from a range of specialisms. Qualitative analysis enabled emerging themes to be identified on both national and comparative bases. Most participants had a poor understanding of their codes. They were unfamiliar with the content and believed they have little practical value because of extensive barriers to their effective use. In many countries nursing codes appear to be ‘paper tigers’ with little or no impact; changes are needed in the way they are developed and written, introduced in nurse education, and reinforced/implemented in clinical practice. La investigación etnográfica se ha desarrollado ampliamente en las últimas décadas, ha sido adoptada por numerosos campos del saber: sociología, psicología social, historia, y otras disciplinas sociales. Desde una perspectiva amplia y tradicional, la etnografía puede entenderse desde una triple acepción: como método, como texto y como enfoque (Guber, 2014). Nos interesa retomar esta última acepción dado que nos conduce a reflexionar en torno a su complejidad, más allá de la palabra dicha, recuperar los gestos, sensaciones, emociones, miradas, sentipensares que (...) dan sentido a los acontecimientos cotidianos. Las múltiples dimensiones de conocimiento que se ponen en juego en el trabajo de campo en tanto experiencia vivida (Quirós, 2011) como investigadores pueden ampliarse y debatirse a partir considerar el hecho de "dejarnos afectar" como instrumento metodológico. Acompañar y comprender los procesos socioeducativos en la escuela secundaria, su cotidianeidad, integra experiencias que constituyen, desde cada sujeto particular, acciones significativas de producción y reproducción social y apropiación cultural, así la vida cotidiana abarca gran cantidad de actividades mediante las cuales estudiantes, docentes, padres dan existencia a la escuela dentro del horizonte cultural que circunscribe cada comunidad. We discuss a recent approach to investigating cognitive control, which has the potential to deal with some of the challenges inherent in this endeavour. In a model-based approach, the researcher defines a formal, computational model that performs the task at hand and whose performance matches that of a research participant. The internal variables in such a model might then be taken as proxies for latent variables computed in the brain. We discuss the potential advantages of such an approach for the (...) study of the neural underpinnings of cognitive control and its pitfalls, and we make explicit the assumptions underlying the interpretation of data obtained using this approach. This essay argues that the practical reason approach to the study of social conventions (and social normativity more generally) fails to adequately account for the fluency of social action in environments that we experience as familiar. The practical reason approach, articulated most recently in Andrei Marmor’s Social Conventions: From Language to Law (2009) does help us, though not wholly adequately, to understand how we tend to react to, and experience, unfamiliar situations or unfamiliar behaviors, that is, those situations in which (...) a certain practice becomes problematic or is problematized, or where we are obliged to, or moved to, justify or deliberate. The reason why the practical reason approach is not wholly adequate when it comes to understanding unfamiliar situations or unfamiliar behaviors is that it tends to subsume the unfamiliar under the familiar, that is, it tends to negatively evaluate anything that is deemed to be not in accordance with the rules and reasons already familiar to the observer. This excludes the possibility of the observer having to transform himself or herself, and thus change what is familiar to him or her. (shrink)

De acuerdo con la tradición dominante de la teoría generativa, la creatividad lingüística es la capacidad de producir infinitas oraciones a partir de un conjunto finito de instrucciones sintácticas. Aunque esta idea de creatividad ha sido aceptada y festejada, sólo se trata de manejar una secuencia de categorías y escoger en cada paso un miembro de cada categoría. En efecto, la así llamada creatividad generativa no es más que una operación secuencial que ofrece opciones para cada punto de la secuencia, (...) y esto es comparable a la operación secuencial en la que completamos la bandeja con la comida disponible en el comedor. De hecho, la creatividad generativa no puede dar cuenta de los procesos verdaderamente creativos, por ejemplo de la invención de palabras nuevas o nombres originales. Por el contrario, el enfoque neurocognitivo asumido por la teoría de redes relacionales sí puede dar cuenta estos procesos genuinamente creativos. En este trabajo se mostrará cómo es el proceso neurocognitivo gracias al cual se crean y se entienden nombres cuya originalidad se basa en la ambigüedad deliberada. (shrink)

A teaching method may not work for all students. Therefore, attention should be paid to the type of students entering the learning environment in order to explain how they perceive the learning environment and achieve. This study investigates students? perceptions and achievement in four learning environments that differed in the degree to which case-based and lecture-based learning were implemented (either separately or combined), hereby making use of students? motivational and learning profiles. Participants were 1098 first-year student teachers who took a (...) course on child development. Results showed that autonomously motivated deep-strategic learners were significantly more positive about each type of learning environment than little motivated and less pronounced deep-strategic learners. However, with regard to achievement, student profiles did not differ. Instead, the learning environment proved to be of significant influence: students in a gradually implemented case-based setting and a completely lecture-based setting scored significantly higher than students in a completely case-based setting. Existing accounts of mechanistic causation are not suited for understanding causation in biological and neural mechanisms because they do not have the resources to capture the unique causal structure of control heterarchies. In this paper, we provide a new account on which the causal powers of mechanisms are grounded by time-dependent, variable constraints. Constraints can also serve as a key bridge concept between the mechanistic approach to explanation and underappreciated work in theoretical biology that sheds light on how biological systems (...) channel energy to actively respond to the environment in adaptive ways, perform work, and fulfill the requirements to maintain themselves far from equilibrium. We show how the framework applies to several concrete examples of control in simple organisms as well as the nervous system of complex organisms. (shrink)

Health is certainly a valuable asset in the life of every human being and of particular relevance for a flourishing childhood. As empirical research concerning the social determinants of health shows, its distribution can, at least to a certain extent, be influenced by the way a society is arranged. Many philosophers now acknowledge that a fair distribution of health has to be a central part of a just society and they discuss to what extent a right to health can be (...) justified. However, they do not typically distinguish between physical and mental health and neglect the special problems arising from these distinct, though related, perspectives. In this paper, we argue in favour of such a distinction and ask whether a minimally just society ought to include mental health among the goods that are to be distributed in a fair way among its children. Furthermore, we investigate the relationship between mental health and happiness and ask whether making mental health a subject of justice implies that children are entitled not only to a healthy but also to a happy childhood. Despite the positive impact of happiness on the lives of children, we conclude that happiness cannot be incorporated into a functional theory of justice, since it does not fully meet the criteria of objectivity, measurability and influenceability. In a questionnaire study on organ allocation 348 students of medicine (102) and economics (246) at the universities of Halle (114 students) and Hannover (234 students) responded to questions concerning their basic attitudes toward alternative criteria of organ allocation. Medical criteria were widely accepted by the respondents. Considerations concerning the patient's value to society were seen as being of minor importance. With respect to reciprocity, we could detect a high share of respondents who would favor former living donors and discriminate (...) against murderers. Among considerations of fairness, the criterion of waiting time gained the highest support. Furthermore, majorities favored the view that health-compromising behavior and differences in age should play a role. Economic considerations were strongly rejected as criteria of organ allocation. Experts in the field of organ transplantation had to rank order a set of 32 patients according to their priority in receiving a donated kidney. The patients were described by the five characteristics that are incorporated in the kidney allocation algorithm applied by Eurotransplant. The priority rankings as defined by the experts were analyzed and patterns of dedsion making identified in the rankings investigated in this study. All patterns could be explained by some type of lexicographical ranking. The larger group (...) of experts preordered tissue compatibility or, more technically speaking, the criterion of HLA match, while the complementary group applied the criterion of the length of waiting time first. Analyzing the finer decision structures of expert rankings and com paring the method of pattern exploration with a conjoint measurement analysis led to two follow-up questions: First, how can the value judgments of the experts be described adequately? Second, which type of aggregated ordering derived from the individual rankings represents them ‘best’? (shrink)

This article explores the maternal experiences of a heterogeneous group of 26 mothers from Granada. The aim is to analyse the needs and demands that these women express with regard to childrearing, using a qualitative methodology. The authors conducted in-depth interviews and analysed the discourses of the mothers following the hermeneutical method. The variables used for sample selection and the themes that emerged during the interviews revealed that the discourses of the mothers revolve around three dimensions: indifference, demands and resignation (...) regarding support for childrearing. The lack of paternal involvement in childrearing appears as a transversal dimension. This article shows that the material conditions of existence marked the differences in the responses of the women regarding support for childrearing, while the sexual division of labour and gender inequalities unified their discourses. This collection of original essays brings together leading legal historians and theorists to explore the oft-neglected but important relationship between these two disciplines. Legal historians have often been sceptical of theory. The methodology which informs their own work is often said to be an empirical one, of gathering information from the archives and presenting it in a narrative form. The narrative produced by history is often said to be provisional, insofar as further research in the archives might falsify present understandings (...) and demand revisions. On the other side, legal theorists are often dismissive of historical works. History itself seems to many theorists not to offer any jurisprudential insights of use for their projects: at best, history is a repository of data and examples, which may be drawn on by the theorist for her own purposes. The aim of this collection is to invite participants from both sides to ask what lessons legal history can bring to legal theory, and what legal theory can bring to history. What is the theorist to do with the empirical data generated by archival research? What theories should drive the historical enterprise, and what wider lessons can be learned from it? This collection brings together a number of major theorists and legal historians to debate these ideas. (shrink)
